Seuk’s Army is a volunteer-based organization.
VOLUNTEER RELEASE AND WAIVER OF RESPONSIBILITY
This is a Waiver and Release of Liability (“Release”) executed by you, (the “Volunteer”), in favor of Seuk’s Army, a non-profit corporation, its directors, officers and agents collectively known as “Seuk’s Army.”
The Volunteer desires to volunteer for Seuk’s Army. The Volunteer understands that such activities may include, but are not limited to, handling animals, cleaning animal areas and waste, attending fundraisers, transporting animals, interacting with the public, and other duties as needed.
The Volunteer hereby freely, voluntarily, and without duress executes this Release under the terms set forth below:
1. Release and Waiver
The Volunteer hereby releases and forever discharges and holds harmless Seuk’s Army, its Directors, Officers, Agents, other volunteers, successors, assigns, and any interested third parties from any and all liability, claims, and demands of whatever kind or nature, whether in law or equity, which arise or may hereafter arise from the Volunteer’s activities with Seuk’s Army.
2. Assumption of Risk
The Volunteer understands that volunteer activities may involve hazardous work and inherent risks, including, but not limited to, handling animals, exposure to feces, urine, and vomit, moving cages and crates, bending, stooping, lifting, transporting animals, and interacting with animals. The Volunteer expressly and specifically assumes all risk of injury, illness, death, property damage, or loss arising directly or indirectly from participation and releases Seuk’s Army from all liability, claims, and demands of whatever kind or nature, whether in law or equity, which arise or may hereafter arise from the Volunteer’s activities with Seuk’s Army.
3. Photographic and Media Release
The Volunteer grants and conveys to Seuk’s Army. all rights, title, and interest in any and all photographs, images, video, and audio recordings taken or made during Volunteer activities. This includes any royalties, donations, proceeds, or benefits derived therefrom. Seuk’s Army may publish and use such media in any format, including websites and other media, for advertising or other purposes as Seuk’s Army deems appropriate.
4. Governing Law and Severability
The Volunteer expressly agrees that this Release is intended to be as broad and inclusive as permitted by the laws of the Commonwealth of Virginia and shall be governed by and interpreted in accordance with the laws of the Commonwealth of Virginia. If any provision is held invalid by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
5. Acknowledgment
By signing below, the Volunteer and, if applicable, the parent or legal guardian acknowledge that they have read, understood, and voluntarily executed this Release.
NOTE: Minors under the age of 18 are NOT permitted to handle animals unless accompanied by an adult. A parent or legal guardian must complete and sign this Release and also complete a volunteer application and waiver.
By agreeing to volunteer with Seuk’s Army, I agree to and understand the following:
- I agree to provide the animal(s) with good loving care, including but not limited to companionship, food, water, shelter, and medication when required. As a volunteer, working with animals, I am expected to treat all animals with kindness and respect, report animal injuries, illnesses, or behavioral concerns to an appropriate Seuk’s Army Board member, and not to handle an animal that makes me feel uncomfortable.
- I agree to hold Seuk’s Army harmless from any direct or consequential damages arising out of this volunteer arrangement, including, but not limited to, property damage and personal injury. Working with animals may be dangerous and can involve physical risk. As a volunteer, I understand and agree to assume any and all liability and risk associated with volunteering for Seuk’s Army and agree to hold
harmless Seuk’s Army, its directors, officers, agents, employees, and other volunteers from any responsibility and liability for any illness, injury, or death related to volunteering for Seuk’s Army. - I acknowledge and agree that Seuk’s Army may terminate this volunteer arrangement at any time with or without cause.
- I agree to conduct myself in a positive, professional manner at all times when involved in Seuk’s Army activities or representing the organization in public, and to report any abusive behavior to an appropriate board member.
- I agree to receive text messages and emails from Seuk’s Army regarding volunteering needs and scheduling.
- I have never been convicted of animal cruelty, neglect, or abandonment.
- Anything donated on behalf of Seuk’s Army becomes the property of Seuk’s Army. No compensation should be expected nor accepted by any volunteer. Seuk’s Army is not responsible for damage or loss of any personal property belonging to a volunteer.
- I understand that, as a volunteer, I am responsible for understanding and abiding by the information contained in these volunteer guidelines and any subsequent information or training provided to me by Seuk’s Army.
Dress Code and Safety
While volunteering, you must wear appropriate clothing. For your safety, wear closed-toe, non-slip shoes and no dangling jewelry. By signing this, you are acknowledging that your clothing may become damaged and/or dirty while volunteering. Seuk’s Army is not responsible for loss or damage to personal property.
Donations and Personal Property
Anything donated on behalf of Seuk’s Army becomes the property of Seuk’s Army. No compensation is expected nor received by the Volunteer.
Certification
Volunteer certifies they are 18 years of age or older. If under 18, a parent or legal guardian must sign on their behalf. Volunteer certifies they have never been convicted of animal cruelty or neglect.
